Terms and Conditions for participation in the Green Business Index (GBI)

  1. I. Description of Green Business Index
    1. Green Business Index (GBI) is n evaluation and monitoring project of environmental responsibility for Romanian companies. In this regard GBI is based on environmental performance indicators recognized at internationally.
    2. The GBI Objectives are:
      1. Evaluating the environmental responsibility of Romanian companies
      2. Monitoring green initiatives in the Romanian business sector
      3. Provision of assistance and training for improving environmental performance of organizations
    3. Top GBI is generated based on the questionnaires filled in by the companies and in conjunction with corresponding justification documents.
    4. The copy right on the questionnaire belongs to Green Revolution Association (further called „Organizers “). No part of the GBI questionnaire, nor related companies (evaluation procedure, participation guide, guide for filling in, substantiation) can be partially or fully reproduced or modified without beforehand explicit permission of the Organizer.
    It is strictly forbidden the use of names and information provided by the Organizers for commercial scopes or for promoting other sites, without the beforehand explicit permission of the Organizer.
     
    II. Stages of Green Business Index
     
    1. Free company registration from 29th March– 28 May 2012;
    2. Filling in the questionnaire(s) from 29th March– 28 May 2012;
    3. Generating the preliminary positioning report;
    4. Evaluation of responding companies by environmental experts from May-July 2012;
    5. Generating the final positioning report;
    6. Generating the GBI 2012 Report;
    7. GBI 2012 Gala  in September 2012
     
    III. Use and confidentiality of information
     
    1. Organizers undertake to keep confidentiality of all delivered information from participating companies: in the registration form, in the GBI questionnaire(s) and the justification documents.
    2. Information are not confidential if (a) they are or they become generally known not as a result of not complying with current Terms and Condition for participation; (b) were already held by the Organizers before they were filled in by the participating company; (c) were discovered by the Organizers, independent of the participating Company; (d) are legally obtained from a third party which acts on behalf of the participating Company and is not held by a confidentially obligation.
    3. The confidential information can be disclosed if required by court of law or enforcement agencies, with preliminary notification of the respective participant company. Also, the confidential information can be disclosed if required by the environmental authorities or for Organizers’ reputation protection and legitimate interests, with a preliminary agreement of the participating Company. The participating Company is obliged no refuse approval in an unreasonable way.
    4. The participating Company agrees that the data of Company representative and its contacts can be disclaimed by the Organizer to partners, sponsors and collaborators.
    5. The Organizers are committed to using filled in information –from registration form and GBI questioner(s), for establishing the top GBI 2012 order, for generating the free report for environmental performance,  for statistical purposes, as base for GBI 2012 Report and for provision of assistance or training.
     
    IV. Participation and obligations conditions for the participating Companies
     
    1. Accepting the terms and conditions for participating represents an obligatory condition for registration in GBI. If a company does not agree with the terms and conditions, it cannot register on  www.gbindex.roand thus it does not have access to completing the GBI questionnaire.
    2. In relation to Organizers, the participating companies are represented by their legal representative or by a representative empowered in this regard.
    3. The participating Company declares that it fulfills the conditions for participating in GBI, respectively:
      1. It is a Romanian legal entity that undertakes its activity in Romania (participating Company),
      2. Is organized as a commercial society.
      3. Is not in: insolvency, bankruptcy, liquidation, was not subject to a recuperation state order from Competition Council or European Commission and this was not executed, it does not have residual budgetary obligation (state budget, local budget locale)
      4. Is compliant with applicable norms and imposed by current environmental legislation in 2011. Otherwise, the participating company does not have access to GBI top, will have access to free GBI evaluation.
    4. The participating Company will keep secret the log-in password on the www.gbindex.ro website and will make sure that no unauthorized person will have access to the password.
    5. If the participating company declares that it was not compliant with applicable norms and imposed by current environmental legislation in 2011 (according to the filter question from the registration stage), the company will not have to access GBI top, but will have access to free GBI evaluation.
    6. The participating company has the right to withdraw from the competition either before deadline for registration or no latter than 28th May 2012, provided that the Organizer is notified in writing, indicating the reasons that lead to this decision.
    7. The participating company agrees to provide Organizers information required for the GBI evaluation (through selection of answers corresponding to their concrete Company situation and detailing them by filling in the obligatory fields   /afferent text boxes). The fields   /afferent text boxes contain information needed for generating environmental performance indicators. If the participating Company decided not to fill the obligatory fields/text boxes, which correspond to the selected variant answers (e.g. quantities, percentages, sums, etc.), a correct environmental performance evaluation cannot be generated based on relevant indicators, nor free positioning and evaluation reports.
    8. The participating company is obliged to provide only correct, precise, up to date, that can not mislead and that reflects the current company situation during the reporting period 2011.
    9. The participating company understands and agrees to delivering any supplementary relevant information needed for generating the top GBI, as per requests issued by the Organizers (supplementary information for companies tie via justification documents for answers provided in the filled questionnaire(s), supplementary questions and clarification questions).
    10. The participating company states and guarantees that it holds all the necessary rights to provide and grant the right of using the information in the benefit of the Organizers, according to the provisions of these Terms and Conditions and takes all responsibility for information correctness and for provision and delivery of rights for using them. Also, the participating company takes responsibility for damages of any nature, including reputation, for information that do not meet the requirement of article 18 could cause.
    11. If the participating company provides false information or which is against good behavior and/or public order, the Organizers reserve their right to disqualify the company from the current edition of the GBI. Also, if the company commits two consecutive offenses of providing false pieces of information, which are against good behavior and/or public order, the Organizers have the right to refuse further participation of the Company to GBI.
    12. If the participating company refuses to provide additional information reasonably requested by the Organizers, it may also be disqualified from the current edition of the GBI.
    13. The decision regarding the disqualification, respectively the refuse of the registration, will be communicated by the organizers to the participating company within 7 days from received evaluation done by the environmental experts based on the contacts provided in the registration form.
    14. The participating company is responsible for all the prejudices caused to the Organizers, to other participating companies or any other third part, by providing incorrect, false, inaccurate information which is against good behavior and/or public order.
    15. The participating company agrees that all information delivered to the Organizers will be collected in a confidential database.
    16. All intellectual property rights regarding any form or questionnaire which the participating Company will fill for participating in GBI, belong to the Organizers.
    17. The participating company is obliged to respect all intellectual property rights, including the name, trademarks, logo, database, which belong to the Organizers.

    19. The participating company agrees to use of information provided to Organizers for evaluating the environmental performance, for determining the order in top GBI 2012, for generating a free environmental performance evaluation report, for statistical purposes, as baseline for GBI 2012 Report and for provision of technical assistance of training. . The info provided by the participating companies for achieving the GBI objective will be evaluated according to the evaluation procedure (link to evaluation procedure).
    20. The participating company states that it acknowledges the Evaluation Procedure previously mentioned and agrees with it.
    21. After finishing the current edition of GBI, respectively September 2012, the participating Company is encouraged to send the Organizers potential suggestions and proposals for  improving the evaluation procedure.
    22. The organizers will in good faith use the information provided by the Company for achieving the GBI objective. The organizers will ensure the objectivity evaluation and equal conditions for all the participating companies. In this regards, the participating Company that sustains achieving the GBI objectives in any way, including sponsorship, will not benefit from a privileged treatment.
    23. The statistical analysis and interpretation of the information provided by the participating companies will be made public on the project website (http://www.gbindex.ro), in the current edition of GBI report, as well as other related publications.
    24. If  an association or non-profit organization wishes to participate in GBI for evaluating its environmental performance for its activities, the  Organizers will allow this, noting that the respective entity will not be part of the top GBI 2012.

Green Revolution Association reserves the right to modify and refresh these rules, as well as the right to suspend, postpone and cancel the project. Should the Terms and Conditions be breached, we reserve the right to undertake the legal measures for protection copy rights.
